Privacy Policy

Introduction

This privacy policy is intended to explain, among other things, how we, Kfar Nofesh Ein Gev Agricultural Cooperative Society Ltd., Company No. 570054015 (hereinafter: the “Resort“, the “Cooperative“, “we“, “us“, “our“), collect and use personal information about you (hereinafter: “you“, “your“), with whom we share this information, and what your rights are with respect to it.

For the purposes of this privacy policy, “personal information” means any data or information that you provide to us and/or that we collect about you, which identifies or enables the identification of you personally (such as your name, email address, telephone number, etc.), including “personal information” and/or “information of special sensitivity” as defined in the Protection of Privacy Law, 5741-1981.

This privacy policy applies to all personal information collected about you by us, including:

  • In the course of your use of our website available at https://eingev.com/ or any other address from time to time, and our booking engine linked to the website (hereinafter: the “Booking Engine“, and together: the “Website“);
  • In the course of your use of our guest platform, as detailed further in Section 3 below (hereinafter: the “Platform” or the “Guest Platform“);
  • During your stay at the Resort, when purchasing various products from us, in the course of receiving any services from us, and/or when contacting us in any manner (hereinafter together: the “Services“).

Please note that additional terms, including with respect to privacy protection, may apply to certain services provided by us, which will be presented to you during your enrollment in and/or use of them.

This privacy policy forms an integral part of our terms of use.

We recommend that you carefully read the terms of this privacy policy before using the Website, the Platform, and/or the Services. By using the Website or the Platform, receiving the Services from us, and/or contacting us in any manner, you confirm that you agree to the terms of this privacy policy in full, including to the collection of your personal information, its processing and storage by us, as well as its sharing with third parties, all as detailed below. If you do not agree to the terms of the privacy policy, you must refrain immediately from any use of the Website, the Platform, and/or the Services.

This privacy policy has been drafted in the masculine form for convenience purposes only, but applies equally to all genders. Likewise, wording in the singular includes the plural, and vice versa, unless otherwise indicated by the context or logic of the matter.

The division of this privacy policy into sections and section headings is for convenience purposes only and shall not be used for purposes of interpretation.

Processing of Personal Information

It is clarified that you are under no legal obligation to provide us with personal information or any other information about you, and to the extent you choose to do so, you represent that you are doing so of your own free will and with consent. However, it is clarified that without providing the required personal information, you may not be able to receive the Services from us, in whole or in part. For example, without providing payment details it will not be possible to complete a room booking at the Resort, and without providing contact details we will not be able to contact you regarding your inquiry.

Please note that some of the fields on the Website are “mandatory,” meaning that in order to receive the desired service from us you must provide the requested information — such fields will be marked with an asterisk (*); to the extent you do not wish to enter the information required in mandatory fields, you may not be able to receive the requested service from us, in whole or in part. Fields that are “optional” are those that are not marked with an asterisk, and you are entitled not to provide the information while still receiving the relevant services, although providing optional information may make our handling of you more precise.

You undertake that all information you provide in the course of using the Website, the Platform, and/or the Services is true, complete, clear, and up to date. To the extent you provide us with personal information about third parties (for example, if you make a room booking on behalf of other people), you represent that you have obtained their consent to the provision of their personal information for the purposes set out in this privacy policy, and that you have brought the provisions of this privacy policy to the attention of those third parties, or that you are their legal guardian.

We do not intend to collect or process personal information about minors, except to the extent such information is required as part of the booking process and/or in order to provide the Services, and to the extent it is indeed required — the collection of such information will always be with the consent of the minor’s parent or legal guardian. If you are a minor and do not have such consent, you are required to stop using the Website, the Platform, and/or the Services immediately. Without derogating from the generality of the foregoing, it is clarified that our Website and Platform are not intended for minors under the age of 18. If you are a minor — you are requested not to use our Website and/or Platform.

What Types of Personal Information Do We Collect About You?

We collect and process the following types of personal information:

Information regarding your bookings. When making a room booking at the Resort through the Website or through our customer service center, and also upon your arrival at the Resort, you will be required to provide, and we will collect, the following information about you: full name, telephone number, email address, identity card/passport number (specifically with respect to foreign residents — also passport photos for the purpose of VAT offset), arrival date at the Resort and length of stay, number of rooms included in the booking, number of people included in the booking, type of room requested and specific requests (such as bed type, meals, etc.), number and details of family members including children who will accompany you and their ages (to the extent relevant to the booking), the last four digits of the credit card used for payment and a token received from the payment processing company (it is clarified that the rest of your credit card details will be processed by external payment processors holding a PCI standard and will be retained by them only), gender, age, home address, country of origin, as well as additional information you choose to provide us in connection with your booking/special requests you wish to raise with us. In addition, to the extent you are staying with us as part of a booking made by a particular group (whether a workplace or any other entity) — we will also collect information about your affiliation with that group.

Please note that the details of the booking you made will also be available to you in the personal area of our Booking Engine. You may log in to the personal area using the booking number you received from us and entering your email address, or by logging in via your Facebook or Google account; to the extent you choose the latter option, information collected about you in the course of your use of our Booking Engine may be transferred to Facebook or Google (depending on the platform through which you chose to log in) — this information will be processed in accordance with the privacy policy of those entities, and we recommend that you review it before logging in; in any event, it is clarified that we are not responsible for the processing of information carried out by those entities.

You may also register with our Booking Engine; to do so, you will be required to provide your full name and email address. In addition, you will be required to choose a personal password that will be used to log in to the personal area — we ask that you choose a unique password that is not used by you to log in to other services/websites.

We ask that you not disclose your login details to other people. You represent that any login to your personal area using your login details, as well as any action performed therein, shall be deemed to have been made by you and with your consent. You release the Cooperative and/or anyone on its behalf from any liability or responsibility for unauthorized use of your details as described above and for the results of such use.

Additional information collected during your stay at the Resort and use of the Services. In the course of your stay at the Resort, the following types of information may be collected about you: information regarding services and products you purchased, information regarding food preferences, medical information (for example, information about allergies and sensitivities), as well as conversations you had with the room service center and the reception desk (which are recorded for control purposes, employee training, and service quality improvement). In addition, to the extent that during your stay at the Resort you choose to log in to your personal accounts via the television device in your room (for example, in order to use Netflix, YouTube, etc.), we may collect information about your use of these platforms; we ask that you make sure to log out of your account after finishing use of these platforms.

The Guest Platform. We use a third-party artificial intelligence (AI) tool for the purpose of supporting and streamlining our services and improving the customer experience; this tool is in fact responsible for managing our WhatsApp, which is available to our customers at all times, and is intended to enable you to make bookings and manage your stay at the Resort, perform online check-in before your arrival, and view information about the services we offer and about attractions in the area. It is clarified that any inquiry made to us via WhatsApp will first be answered by an AI-based bot; however, you may request to speak with a human representative, and we will make every effort to accommodate your request as soon as possible. In this context, it should be noted that we endeavor to conduct orderly oversight of the Platform’s activity and the responses provided through it, and from time to time there may also be conversations with human representatives on our behalf.

Without derogating from the generality of the foregoing, it is clarified that all information entered into the Guest Platform will be stored and processed by us in accordance with the terms of this policy.

Personal information collected automatically while browsing the Website and the Platform. We may collect personal information about you, such as your IP address, the type of browser from which you are browsing, the pages you accessed, etc., through technological tools used by us, primarily Cookies, as detailed in our separate cookie policy documents.

Personal information provided to us by third parties. We may receive personal information about you from third parties, such as travel agents, booking engines, etc., and combine it with information we collect through our Website, Platform, and Services. It is clarified that personal information provided through an entity that made a booking on your behalf on another platform, which is transferred to us, will constitute an integral part of our customer database and will be subject to the terms of this privacy policy.

Contacting us. When using the “Contact Us” window on the Website, you will be required to provide the following information: full name, telephone number, and email address. You will also be required to enter your request in the free-text window. It is clarified that all information you enter in the free-text window will be transferred to us as-is, and therefore we ask that you enter only the details essential to your request; to the extent you choose to enter personal information about yourself (or about others) in this window, it is clarified that you consent (or that you have obtained the consent of the person the information concerns) to our collection and processing of, and use of, the personal information entered, in accordance with this privacy policy. The foregoing applies, with the necessary changes, also to the extent you choose to contact us in any other manner, including through the Guest Platform, by email, or through our various social media pages. It is clarified that to the extent you choose to contact us through a third-party platform, the content of the correspondence may be transferred to that platform — this information will be processed in accordance with the privacy policy of the relevant platform, and we recommend that you review it before contacting us through it.

The call center. Telephone calls received at our customer service call center may be recorded for control purposes, employee training, and service quality improvement. It is therefore clarified that all information you disclose during your call will be recorded and retained by us as-is, and therefore we ask that you disclose to us only essential details. To the extent you choose to disclose personal information about yourself (or about others) during the call, it is clarified that you consent (or that you have obtained the consent of the person the information concerns) to our collection and processing of the personal information disclosed, in accordance with this privacy policy.

Security cameras and electronic key card. Information captured by security cameras located in public areas within the Resort premises, such as the lobby and corridors, as well as information collected through the electronic key card you receive during your stay at the Resort regarding your entries into your room.

Photographs. We may publish photographs of you taken during your visit to the Resort, subject to your consent thereto. In addition, to the extent you tag one of our managed social media pages, including on Instagram or Facebook, and/or publish a post directly on one of our pages — we will regard this as your consent to the sharing of the photograph you tagged and/or the post you published, on our social media pages and/or on our website.

Events and conferences. When contacting us for the purpose of holding private events or conferences on the Resort premises, you will be required to provide the following information: full name, telephone number, email address, date and type of event, number of participants, number of rooms requested, and free text, subject to Section 6 above.

Suppliers. In the course of our engagement with our various suppliers, we may collect and process personal information about the supplier’s representatives (to the extent the supplier is a company or other corporation) and/or personal information about the supplier itself (to the extent the supplier is an individual, such as a “freelancer”). Among other things, this information may include full name, telephone number, email address, place of employment, details regarding education and professional experience, identity card number, etc. It is clarified that you are under no obligation to provide us with personal information about you as described above, but without providing the relevant information we will not be able to manage the engagement with the supplier.

How Do We Use the Personal Information Collected About You?

The use of the personal information collected about you will be made for the following purposes:

  • Operating the Website and the Platform. In order to enable you access to the Website and the Platform, as well as for their operation, monitoring, handling of any malfunction therein, their improvement, and their development.
  • Providing the services offered by us and managing bookings. Including in order to provide you with information about the Services, to enable you to make new bookings, to manage bookings made and collect payment in connection therewith, to provide the Services actually booked, to tailor our Services to your various preferences and improve your hospitality experience at the Resort, and also in order to receive feedback about your stay at the Resort.
  • Operating our business and business development. For the purpose of operating our activities, improving the quality of the services provided by us (including through the call center and reception desk), developing new services, identifying usage trends and visit patterns on the Website and Platform, checking the effectiveness of our advertising campaigns, evaluating the performance of third parties acting on our behalf (such as travel agencies and booking engines), and managing and forecasting the Resort’s occupancy during a given period.
  • Staying in contact, providing customer service, and sending operational updates. In order to stay in contact with you regarding your bookings and requests; in order to update, notify, and inform you of updates regarding our services, the terms of use, and/or the privacy policy; in order to send you operational information (for example, booking confirmation).
  • Marketing mailings and direct mailings. Your contact details will be used by us for the purpose of sending marketing mailings and advertising materials (subject to your explicit consent thereto, in accordance with the Communications (Telecommunications and Broadcasting) Law, 5742-1982) and also for the purpose of sending direct mail (in accordance with the Protection of Privacy Law, 5741-1981) from time to time. You may remove yourself from the direct mailing list and/or the marketing mailing list at any time by clicking the dedicated link included in the message itself or by contacting us using the contact details in Section 12 below. It is clarified that even after a removal request, we may contact you with messages that we are required by law to send you or that we are permitted to send even without consent.
  • Safety and security. In order to maintain your safety and security, as well as that of the other guests, visitors to the Resort, suppliers, and employees.
  • Information security. For information security purposes, and to detect and prevent fraud, misuse, and/or unlawful activity.
  • Third parties. For the purpose of transferring information to third parties as detailed in Section 5 below.
  • Artificial intelligence (AI). To the extent you choose to use the Platform, the personal information about you, both that entered by you directly into the Platform and that stored in our systems, will be processed using a third-party artificial intelligence tool.
  • Creating aggregate, anonymous, or statistical data. We will use such information to identify trends and analyze information, to develop, improve, and tailor the services offered by us and third-party services we use, to improve the service experience, and for additional statistical purposes.
  • Compliance with legal and regulatory obligations. Including compliance with statutory requirements and regulatory obligations, including in connection with legal proceedings, judicial orders, requirements of competent authorities, and the like.
  • Establishing and protecting legal rights. In order to protect our activity, our rights, our security or our property, ours and/or that of others, and to enable us to assert our rights to obtain remedies or to mitigate our damages.

Sharing Information with Third Parties

We may transfer information about you to third parties in Israel or abroad, including in countries that provide a level of privacy protection lower than that customary in the State of Israel, as detailed below:

  • Service providers and external suppliers acting on our behalf. We will share personal information about you with external service providers who assist us in managing and operating the Website and the Guest Platform, as well as in managing our business activity and providing the Services, of the following types: information technology (IT) system providers, the booking engine provider, the Platform provider, storage providers (including via cloud computing), payment and clearing processors, as well as various consultants, including legal advisors, insurers, and accountants. These providers, except for the Platform provider, will receive access to the information solely for the purposes of performing their services for us. Without derogating from the generality of the foregoing, the various providers will be able to use de-identified information regarding usage patterns on the platforms and/or services provided by them for the purpose of improving and developing their services.
  • External booking engines. You may book a room at the Resort online through external booking engines with which we work, such as Booking, Agoda, etc. Please note that use of these platforms is subject to their own terms of use and privacy policy, as stated in Section 9 below. In certain cases, including in the event of a legal dispute — we may transfer personal information about you to the platform through which you made the booking.
  • Representatives on your behalf or travel agents. We may transfer personal information about you to third parties acting on your behalf, to the extent they provided us with personal information about you for the purpose of booking a room at the Resort and/or other use of the services offered by us (for example, your travel agent, personal assistant, employer, spouse).
  • Organizational change or merger. In the event that we transfer or assign our activity, ownership of the Cooperative, or our rights and obligations, in whole or in part, including the Website or the Platform, to third parties, or merge with another entity or undertake a reorganization (including in the course of negotiations toward such transactions) or in the context of insolvency proceedings.
  • In order to comply with legal provisions or requirements of competent authorities. Pursuant to a legal obligation or authority, in accordance with the instructions of a competent authority or a judicial order.
  • Enforcement of rights or legal proceedings. For the purposes of examining claims and in the context of a proceeding and/or legal dispute conducted between you or someone on your behalf and the Cooperative or someone on our behalf, or legal proceedings between you and a third party in which we are required to provide information, testimony, or documents.
  • Data analysis and marketing. We may share personal information as well as statistical data with companies that assist us in activity related to advertising, sales promotion, and marketing, or with analytics service providers or search engines that assist us in improving and optimizing the Website/Platform.

The transfer of personal information to third parties will be limited to the purposes listed in this policy only, and will be carried out to the extent and scope required at our discretion. It is clarified that the foregoing does not derogate from our right to transfer de-identified information to third parties.

Information Security

We employ accepted information security measures with respect to the information in our possession, in accordance with the provisions of the law applicable to us. We use, among other things, means and safeguards to preserve confidentiality and privacy and to prevent unauthorized access to information, and we examine the updating of these mechanisms from time to time.

Although we make reasonable efforts to protect the information, the transfer of information via the Internet, its storage on cloud-based storage servers, and its processing using artificial intelligence systems can never provide absolute protection. Therefore, you confirm that you are aware that we cannot guarantee the absolute protection of the information collected about you or guarantee that no unauthorized access, transfer, alteration, or loss of the information will occur.

Payment processing is carried out securely through third-party providers holding a PCI standard for the purpose of securing your payment details, who are directly responsible to you under their own terms of use and privacy policy. It is clarified that the Cooperative has no control over information security at the payment processors, and therefore we will not bear responsibility for any damage or loss, direct or indirect, of any kind, caused to you as a result of the payment processing.

Data Retention Period

As a rule, we retain personal information about you for the period of time required to achieve the purposes set out in this privacy policy, or for a longer period to the extent permitted and/or required by law.

Information contained in backup files may be retained for a longer period, in accordance with our backup policy.

De-identified information will be retained indefinitely (to the extent this is not prohibited by law).

Your Rights With Respect to the Information

You are entitled to request to review the personal information retained about you in our databases and to request to update, correct, or delete information that is incorrect, incomplete, unclear, or outdated, subject to law. To exercise your rights, you may contact us using the contact details mentioned in Section 12 below.

Third-Party Websites/Platforms/Services

We may present to you links and/or references to websites, platforms, applications, and/or services of third parties. It is clarified that we have no influence over or responsibility for the activities, services, or content of third parties, and information provided to and/or collected by those third parties will be processed in accordance with the terms and policy of those entities. Therefore, if you choose to engage with such a third party in order to receive services directly from it and/or click on a link directing you to the website/platform of such an external entity, our recommendation is that you carefully read the terms of use and privacy policy of that entity.

Changes to the Privacy Policy

We reserve the right to update or change the privacy policy from time to time, as necessary and at our sole discretion, without any obligation to provide notice, whether in advance or after the fact. If updates are made, they will take effect upon the presentation of the updated privacy policy on the Website and the Guest Platform, with the date of the last change reflected at the top of the document. We therefore recommend reviewing this policy from time to time; continued use of the Website, the Guest Platform, or the Services after the policy is updated indicates your consent to the updated terms of the privacy policy.

Governing Law

Any dispute arising in connection with this privacy policy shall be governed by the laws of the State of Israel, and the competent courts in the Northern District shall have exclusive jurisdiction to hear the dispute.
